This document is published by Ohana Tech LLC and governs the Victory Grids service and the Victory Grids SMS messaging program.

These are the Terms of Service (“Terms”) of Ohana Tech LLC. They govern your use of the Victory Grids app and website at victorygrids.com (the “Service”), which is owned and operated by Ohana Tech LLC. Victory Grids is the brand under which we operate the Service and the Victory Grids SMS messaging program. By using the Service, you agree to these Terms.

Using the Service

Victory Grids is a real-time multiplayer Squares pool game. You are responsible for your account, for keeping your login secure, and for the accuracy of the information you provide.

Eligibility

You must be legally permitted to use the Service in your jurisdiction. Victory Grids provides the tools to run Squares pools; you are responsible for ensuring your use complies with all applicable laws.

SMS notifications

The Service offers optional SMS notifications for board reminders, board lock and go-live alerts, winner notifications, and messages from pool hosts. You opt in only when you provide a mobile phone number on a Service form that displays the SMS consent disclosure and submit that form. Consent to receive text messages is not a condition of purchase or of participating in any pool. Message frequency varies and depends on the pools you join and the games they follow — typically a few messages per game or event. Message and data rates may apply.

We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes. We use it only to send the Victory Grids messages described above.

Your use of that program is governed by our SMS Terms. You can opt out at any time by replying STOP to any message, or get help by replying HELP.

Disclaimer & limitation of liability

The Service is provided “as is” without warranties of any kind. To the fullest extent permitted by law, Ohana Tech LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the Service.

Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
